Bio Harvest Privacy Policy
Bio Harvest Ltd. (“Bio Harvest”, “Company”, “our”, “we” or “us”) respects the privacy of the users (“User” or “you”) of its site www.vinia.com (the “Site”), and is committed to protect the personal information that its Users share with it. We believe that you have a right to know our practices regarding the information we may collect and use when you use the Site.
Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at https://vinia.com/terms-of-use/ (the “TOU”), which this Privacy Policy is incorporated thereto by reference.

1. Your Consent (PLEASE READ CAREFULLY!)

BY ACCESSING THE SITE AND/OR USING THE SITE, ESPECIALLY BY REGISTARING AND OPENING AN ACCOUNT (AS SUCH TERM IS DEFINED IN THE TERMS OF USE), YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY (THE “PRIVACY POLICY”), INCLUDING TO THE COLLECTION AND PROCESSING OF YOUR PERSONAL INFORMATION (AS DEFINED BELOW). IF YOU DISAGREE TO ANY TERM PROVIDED HEREIN, YOU MAY NOT USE THE SITE.
Please note: you are not obligated by law to provide us with any Personal Information. You hereby acknowledge and agree that you are providing us with Personal Information at your own free will, for the purpose of providing you with the Site and the Products. You hereby agree that we may retain such Personal Information pursuant to this Privacy Policy and any applicable laws and regulations.

2. Which information we may collect on our Users?

We may collect several types of data and information from our Users:

a. The first type of information is non-identifiable and anonymous information (“Non-personal Information”). We are not aware of the identity of the User from which we have collected the Non-personal Information. Non-personal Information which is being gathered consists of technical information and may contain, among other things, the smart-phone and OS’s version, User’s screen resolution, duration of usage of the Site, browser language, etc.

b. Other type of information is individually identifiable information (“Personal Information”). This information may identify an individual or may be of a private and/or sensitive nature. Users of the Site may choose to register and open an Account, and in order to do so they will be asked to provide their email address or, alternatively, login through their existing Facebook account. In addition, Purchasers, as such term is defined in the TOU, will be requested to provide their full name, address, email address, phone number, and last 4 digits of their credit card number. Purchaser may also choose to provide information regarding their age and sex.

c. When using the Site and in order for you to purchase the Products, you will be asked to provide certain payment information necessary for processing the payment for such Products (the “Payment Information”). The payment shall be made via our third party payment service provider’s payment gateway, and all Payment Information you provide hereunder shall be provided directly by you to such payment service provider under the relevant terms and privacy policy of such third party, as set forth on the relevant payment gateway web page, and Bio Harvest shall not receive nor store any of your Payment Information, except as expressly provided herein.

For avoidance of doubt, any Non-Personal Information connected or linked to any Personal Information shall be deemed as Personal Information as long as such connection or linkage exists.
We do not collect any Personal Information from you or related to you without your approval, which is obtained, inter alia, through your active acceptance to the Terms and the Privacy Policy.

3. How Do We Collect Information on Our Users?

There are two main methods we use:

a. We collect information through your use of the Site. In other words, when you are using the Site, we are aware of it and may gather, collect and record the information relating to such usage, either independently or through the help of third-party services as detailed below.

b. We collect information which you provide us voluntarily. For example, we collect the Personal Information that our Users provide us when registering to our Site. We store the Personal Information and diagnosis results either independently or through the help of our authorized third-party service providers as detailed below.

4. What are the Purposes of the Collection of Information?

Non-personal Information and Personal Information are collected in order to:

  • Provide and operate our Site and related services in connection with our Site.
  • Be able to ship the Products to a Purchaser.
  • Be able to deliver and enhance the Site, provide the Users with technical assistance and support and to provide the Users with updates regarding the Company’s developments etc.
  • Be able to send our Users brochures and other marketing materials if requested.
  • Use it to create cumulative statistical data and other cumulative information and/or other conclusive information that is non-personal, in which we and/or our business partners might make use of.
  • Manage and make risk evaluations, improve our cyber security abilities, prevent and defend from frauds, faults or any other illegal or forbidden activity.
  • Act according to the law, and obey all judicial or regulatory demands.

5. Where Do We Store Personal Information?

Information regarding the Users will be maintained, processed and stored by the Company and our authorized affiliates and service providers in USA and in Israel, and as necessary, in secured cloud storage, provided by our third party service provider.
While the data protection laws in the above jurisdictions may be different than the laws of your residence or location, please know that the Company, its affiliates and service providers that store or process your Personal Information on the Company’s behalf are each committed to keep it protected and secured, pursuant to this Privacy Policy and industry standards, regardless of any lesser legal requirements that may apply in their jurisdiction.
You hereby accept the place of storage and the transfer of information as described above.

6. Sharing Information with Third Parties

The Company will not share any Personal Information it collects with any third party. Notwithstanding, the Company may disclose Personal Information in the following cases: (a) to satisfy any applicable law, regulation, legal process, subpoena or governmental request, whenever the Company believes in good faith that it is legally bound to share such information; (b) to enforce this Privacy Policy and/or the TOU, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to User’s support requests; (e) respond to claims that any content available on the Company’s Site violates the rights of third-parties; (f) to respond to claims that contact information (e.g. name, e-mail address, etc.) of a third-party has been posted or transmitted without their consent or as a form of harassment; (g) to protect the rights, property, or personal safety of the Company, its Users, or the general public; (h) when the Company is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (i) to collect, hold and/or manage your Personal Information through the Company’s authorized third party service providers, as reasonable for business purposes, which may be located outside of Israel, as further detailed below; (j) pursuant to your explicit approval prior to the disclosure; or (k) cooperate with third parties for the purpose of enhancing the User’s experience.
For avoidance of doubt, the Company may transfer and disclose Non-personal Information to third parties at its own discretion.

7. Deletion or modification of Personal Information

If for any reason, you wish to modify or delete your Personal Information please send us an email to contact@vinia.com and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws. Note that unless you instruct us otherwise we may retain your Personal Information for the minimal period of time required to provide you with our Site and Products, or pursuant to any applicable law.
Please note, upon request to delete your account, the Company may depersonalize (and un-identifiable) your activity history for the purpose of enhancing and improving our Site.

8. Minors

To use our Site, you must be over the age of sixteen (16). Therefore, the Company does not knowingly collect Personal Information from minors under the age of sixteen (16) and does not wish to do so. We reserve the right to request proof of age at any stage so that we can verify that minors under the age of sixteen (16) are not using the Site.

9. Security

We take a great care in implementing and maintaining the security of the Company’s Site and its User’s Personal Information. The Company employs industry standard procedures and policies to ensure the safety of its Users’ Personal Information, and prevent unauthorized use of any such information. However, we do not guarantee that unauthorized access will never occur.

10. Third Party Software/Service

While using our Site we may be using third party software and/or service for various needs, inter alia, in order to collect and/or process the information detailed herein (the “Third Party Service”). Third Party Services includes the following services:

11. Cookies

When you access or use our Site, the Company may use industry-wide technologies such as “cookies” (or similar technologies), which store certain information on your computer (“Local Storage”) and which will allow us to enable automatic activation of certain features, and make your service experience much more convenient and effortless. For example, the cookies will assist the Company to enable automatic connection to the Site. It is easy to prohibit the Local Storage, to erase cookies from your computer’s hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. However, if you block or erase cookies your online experience may be limited.

12. Direct Marketing

Promotional Messages: By registering to our Site and/or providing Bio Harvest with your e-mail address or any other contact information (such as your mobile phone number), you expressly agree to receive promotional content, messages or calls from Bio Harvest or our partners (acting on our behalf) through such means. Accordingly, we shall be entitled to call you or send you promotional content or messages by e-mail, SMS, direct text messages, marketing calls and similar forms of communication.
If you wish not to receive such promotional messages or calls, you may notify Bio Harvest at any time or follow the “unsubscribe” or “stop” instructions contained in the promotional communications you receive.
Service Messages: Bio Harvest may also contact you with important information regarding our Site and related services. For example, we may notify you (through any of the means available to us) of changes or updates to our Site, payment issues, service maintenance, etc. You will not be able to opt-out of receive such service messages.

13. Changes to the Privacy Policy

The terms of this Privacy Policy are unseparated part of the Site and will govern the use of the Site and any information collected therein, and should not be separated in any way from the Company’s TOU. The Company reserves the right to change this policy at any time, so please re-visit this page frequently. We will notify you regarding substantial changes of this Privacy Policy by changing the link to the Privacy Policy in the Site. Such substantial changes will take effect seven (7) days after such notice was provided on our Site. Otherwise, all other changes to this Privacy Policy are effective as of the stated “Last Revised” date and your continued use of the Site after the Last Revised date will constitute acceptance of, and agreement to be bound by, those changes.

14. General

This Privacy Policy, its interpretation, and any claims and disputes related hereto, shall be governed by the laws of the State of Israel, without respect to its criminal law principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being litigated in and decided exclusively by a court of competent jurisdiction located in Tel Aviv, Israel.

It is clarified that any use of the information, will be done in the sole discretion of the Company, and the Company is not obligated to use all or part of this Information.
